Absolutely, she can go for stamping in India with your H1B approval and get it stamped. If she were in US, based on your H1B approval she will get an Dependent approval notice and a new I-94, she still needs H4 visa to travel.
If you file for H1B renewal in regular process it might take more time, so if you are in a hurry then go for Premium.

Hello I am leaving for India in two days and have still not received my H1B approval. The receipt date is May 19th 2009. It is being processed at the CA center, is there anything I can to do get it soon.
It was a regular processing one, not the Premium processing one.
Help please!!!!
I am not sure what kind of help you are expecting from members. It seems you already are aware of Premium Processing (PP) service. If you had travel plans, you should have filed H1 under PP and not under regular processing. Anyways, you can upgrade your pending H1 to PP now by filing a form I-907 along with a copy of H1 receipt notice. But I dont think you will get your approval in the next 2 days. It usually takes atleast a week to 10 days to get it, that if its approved with no RFEs.

What is the best possible solution to get around different place birth on Passport and BC. Any has affidavit format for such issue please share it.
According to chat transcript from a lawyer's site some one had the same question. The answer is "USCIS does not care much about secondary document like passport and what's in the primary document like Birth certificate is important and matters". In other words they may not be comparing the passport and birth certificate for place of birth. Just my 2cents as I'm not a lawyer.

I have valid H-1 visa to re-enter US. My visa is valid till Dec 2011. I already got that stamped when i went to india last year.
So I shouldn't run into any problems at the port of entry, even if my AP gets approved while I am out of the country, right? Thanks so much for taking time to answer.

If they'd only "fix" the Social Security Card to be more secure, I'm sure you'd reduce much of the illegal employment. the way the SS card is designed right now, anyone could print out as many of these on his home printer.

* They filed for an EB-3 Labor Certification (RIR) and I-140 with a priority date of April 2003 on my behalf.
* My H1-B expired in March 2006 and they filed for a 3-year extension, which was approved (till March 2009).
* In the meantime, both my Labor and I-140 were approved. I had been waiting to apply for my I-485 since then.
* Now, I'm switching employers (because of a RIF in company X) to company Y, who were working on making me an offer.
* However, company Y's legal department came back saying that they cannot apply for an H1-B transfer because the current law doesn't allow transfers from an H1-B extension (after the original 6-year H1-B has expired).
Could somebody advise me if this is really true?

I've an appointment in October at Munich, Germany consulate for H1B stamping. Because of time constraints I decided to get the stamping done when I'm out there for work. I've already obtained the german visa (though had to provide plenty of explanation !). This is my 9th yr extn (MS, EB2 - 140 approved)
- Can anyone share their experience at the Munich consulate?
- or, should I plan going to Canada and trying rather taking the risk in Germany?

I have experience with Frankfurt. They gave me 221(g) for security clearance. I had to wait in Germany for nearly 2 months. I think the likelihood of getting a 221(g) will be high.
Wherever you go, be prepared for 221(g) and a lengthy wait (3-4 months). I.e., make sure you have the resources to stay for that long a time wherever you decide to go.
